The Texas Residential Construction Commission (TRCC). The house that Bob Perry built.

In 2003 the Texas Legislature created the Texas Residential Construction Commission (TRCC, pronounced "trick") by passing House Bill 730. This bill, written by the Texas Association of Builders (TAB), was promoted to our elected officials as providing protection for new homebuyers from costly construction defects. Unfortunately the recent audit of the TRCC by the Comptroller of Texas concluded the TRCC "functions as a builder protection agency". It is clear from this audit, the TRCC is nothing more than a TRiCC on the homebuyers of Texas and our elected officials.

The TRCC was created due to an outpouring of complaints by angry homebuyers with construction defects, yet not one single consumer advocate was consulted when Mr. John Krugh, senior vice president and corporate counsel for Bob Perry Homes, drafted the bill. Mr. Krugh was later appointed, by Governor Perry, as one of members of the Commission.

The bill was filed by State Representative Alan Ritter(D Beaumont), a lumber salesman and a member of the Texas Association of Builders. He was later honored by the TAB for his role in passing the bill, creating the Commission.

The Commission was granted authority to create a "State Sponsored Dispute Resolution Process" (SIRP) a mandatory process to assist homeowners mediate their complaints with a builder. It authorized the Commission to create "Warranty and Performance Standards" to define standards for new home construction. And it created the Arbitration Task Force to research the continued abuse of mandatory binding arbitration used by homebuilders.

As the audit disclosed, the resolution process is a costly, lengthy, and complicated process requiring the assistance of an attorney to navigate, exactly the opposite of what it was advertised. The warranty standards originally created by the builders and fashioned after the "worthless" 10-year warranties provided by homebuilders, provides less protection for the biggest investment of a lifetime than a cheap foreign made new car. Once again the builders falsely claimed these standards would benefit the homebuyer.

The arbitration task force was to research the continued abuse of arbitration to resolve defects in new homes. All of the initial task force members had ties with the homebuilding industry or the American Arbitration Association. Membership also included the President of the TAB. Needless to say, the results of this task force has been slanted and the homebuilder industry continues to claim arbitration is good for the consumer.

The homebuilding industry's response to the Comptroller's audit is predictable: "Trust us. It will get better." But trusting the homebuilding industry to fix the TRCC is like trusting a fox to fix hen house security. They have tricked the consumers and fooled our elected officials long enough. Our elected officials, regardless of party, should stop protecting this industry and start demanding protection for new homebuyers. If they can't be trusted to provide simple protection for the biggest investment of a lifetime, then they can't be trusted with our health care, insurance, our teachers, and our children's education. And in November the voters in Texas should demand massive reforms of this agency from all candidates.

The audit by the Comptroller has validated our long lasting concerns since House Bill 730 was filed. The TRCC, built on a cracked foundation, was created by the builders, for the builders, with no input from consumer organizations. Until the foundation is fixed, the TRCC will remain nothing more than a huge "TRiCC" on the consumers of Texas and on our elected officials.

Governor Perry. We're number one! We're number one!

In the most recent TV commercial aimed at Joe "After he drank a six pack", Governor Rick Perry sharply turns to the camera and says "I'm proud of Texas. Are you?". After anyone drinks a six pack, they just might agree with the Governor, but when they wake up and realize their head hurts, and the Governor left them with the bar tab, they might begin to think. For once.

Being proud of Texas has absolutely nothing to do with being proud of Rick Perry. Being number one sometimes isn't that good. For instance we are number one in:

  • College Football (yea! We ARE number one!)

  • Highest home insurance rates

  • Percentage of Population without Health Insurance

  • Percentage of Uninsured Children

  • Amount of Toxic Emissions from Manufacturing Facilities

  • Amount of Toxic Release Inventory Chemicals Used by Manufacturing Industries

  • Number of Clean Water Permit Violations

  • Number of Hazardous Waste and Spills

  • Number of Adults in the Criminal Justice System

  • Number of Firearm Deaths

  • Number of Registered Machined Guns

  • Number of Traffic Fatalities

  • Number of Alcohol-Related Traffic Fatalities

    Tom DeLay jet sets across America for $14,000 paid by Fox TV


    According to the Austin American Statesman: Four days after U.S. Rep. Tom DeLay's stunning indictment last September in Travis County, the political talk show "Fox News Sunday" trumpeted an exclusive interview with the combative Texas Republican.

    Unsaid, but revealed in documents DeLay later filed in the U.S. House, was that DeLay's Oct. 2 appearance cost Fox News $14,000.

    The money rented a private jet to ferry DeLay from a small airport near his Sugar Land home to Fox studios in Washington. The next day, after engaging in a give and take with host Chris Wallace, DeLay and his Capitol Police security detail were flown back to suburban Houston.

    Comptroller Rylander nails Texas Homebuilders Commission

    Houston TX Jan 23, 2006. Texas Comptroller Carole Keeton Rylander issued a very stern review of the Texas Residential Construction Commission (TRCC pronounced "trick") which was to help homeowners with construction defects. "After reviewing the TRCC and its enabling statue, it is clear that the agency functions as a builder protection agency." states the report.

    "This report validates the concerns we have had ever since this Commission was proposed in 2003. The TRCC has been nothing more than a trick on the homebuyers of Texas and our elected officials." said John Cobarruvias President of the Texas chapter of Homeowners Against Deficient Dwellings.

    The report criticizes the Commission for being stacked with builder friendly Commissioners, including the Vice President of Bob Perry Homes, Governor Rick Perry's biggest donor. The mandatory inspection process was found to be expensive and nothing more than a bureaucratic roadblock. And the Commission lacks any enforcement over the builders who refuse to make repairs.

    Comptroller Rylander concludes "...if it was up to me personally, I would blast this TRCC builder-protection agency off the bureaucratic books"

    "I reluctantly agree. This Commission was built on a flawed foundation which cannot be repaired. It must be torn down and we must start over" said John Cobarruvias.

    Tom DeLay's staff. Let the whining begin.

    What a surprise! The Houston Chronicle has reported that Tom DeLay's campaign staff is complaining about the Chronicles recent poll on DeLay showing his support in his district has significantly eroded. According to the article Support for DeLay has fallen; it's in the numbers:

    Last week, an e-mail sent to supporters of U.S. Rep. Tom DeLay by his campaign manager, Chris Homan, charged that a poll conducted on the Chronicle's behalf was a "not-so-well-crafted attempt to deceivingly make it appear as if Tom DeLay is losing support of Republicans."

    The telephone survey of 560 registered voters in the 22nd Congressional District was conducted Jan. 9-12, a few days after DeLay relinquished his quest to regain his position as House majority leader. The congressman has been engulfed in controversy. He faces charges in Travis County related to campaign fund raising for 2002 legislative races and an unrelated federal probe involving his ties to lobbyist Jack Abramoff.


    Imagine what DeLay's staff could do for gas prices, cost of education, homeland security, etc etc if they would stop whining and start putting their time and effort into something more important.

    DeLay ad to run in Houston.

    According to the Houston Chronicle CH 26 will be airing the ad against Tom DeLay that they refusede to air in early January. This ad was created by Public Campaign Action Fund and can be viewed here.

    According to the Houston Chronicle: The groups unveiled the first version of the ad Jan. 9. The stations — KRIV, KTRK (Channel 13), KHOU (Channel 11), and KPRC — sold airtime to run the spot for a week beginning on Jan. 11.

    On Jan. 10, DeLay campaign lawyer Don McGahn sent a letter to the stations warning that the commercial contained several falsehoods and that airing it could land them in court.

    The stations pulled the spot, which could still be seen on cable and the groups' Web sites.

    Two days later, the nonpartisan group FactCheck.org, which reviews the accuracy of political ads and is a project of the Annenberg Public Policy Center at the University of Pennsylvania in Philadelphia, said the ad wasn't false, just ambiguously worded.


    You have to wonder if the TV stations refused to run the ad on purpose in order to generate more attention to the ad when it does run. Whatever.

    Trusting the Republican Party with Ethics Reform is like trusting Al Queda with Homeland Security.

    After the Abramoff scandal, DeLay's indictment, Rep Cunninghams admission of taking millions for kickbacks, Rep Ney from Ohio stepping down from his leadership position, four of DeLay's previous staff members being either indicted or investigated, and on and on, what do you really expect the Republican party to do? Of course they will try to look like the party of reform and propose weak reform packages.

    What do you expect when we allow the criminals rewrite the laws for criminals?

    It just gets worser and worser

    Not only is four of Tom DeLay's former staff members either have been indicted or are under investigation, but a recent poll by the Houston Chronicle shows DeLay is in serious trouble at home.

    The poll found that if the general election were held today, Lampson would get 30 percent of the vote, DeLay 22 percent and Stockman 11 percent. The ballot also will include a Libertarian Party nominee.

    "The numbers I saw were encouraging," Lampson said. "They show that the people of this district want a representative who will make headlines for the right reasons, like improving homeland security, fiscal discipline and education.

    "There is a long time between now and Election Day, and we're going to continue working hard for every vote."


    On the ground in Harris county, the mood seems to be worse. Few if any are interested in re-electing DeLay. Some at NASA wonder how NASA can hold it's head up high to the American people while having the stench of DeLay and his lapse of ethics hanging on their neck.

    There comes a time when the heap of trash gets so high and the stench of corruption that wheher they are clean or not just doesn't matter anymore. It is just time to take out the trash.

    Carolyn Keaton Rylander Strayhorn hammers the builders.

    The comptroller will be releasing an audit of the Texas Residential Construction Commission (TRCC pronounced “trick”) this week. This Commission has been heavily critized for its overbearing bias towards the homebuilding industry. Instead of providing protection for new homebuyers, the Commission has provided ample protection for the builders. Read the article by the Houston Chronicle.

    Rylanders audit has already been under fire, even before the report has been release. Representative Swinford has asked the Attorney General to determine whether Rylander has the authority to audit the Commission.     Needless to say Rylander could be playing politics since the Commission is Governor Perry’s personal playground, appointing John Krugh the VP of Bob Perry Homes to the Commission that should regulate Perry Homes. This was right after Perry gave Perry $100,000. (Confused yet?) Also, Krugh wrote the bill which created the Commission. He also wrote the warranty standards.

    This Commission is sick. It is a complete joke. The Texas Association of Builders claimed this Commission was to provide consumer protection. Instead they played a huge TRiCC on the public and our elected officials.

    Congressman DeLay is toast.

    In a letter to the Republican Leadership, Congressman Tom DeLay has given up his leadership position giving the GOP an opportunity to elect new leadership. http://www.chron.com/disp/story.mpl/front/3572030.html

    In the category of "where there is smoke there is fire" or "something really stinks" at least four of Tom Delay's staff have been indicted or is under investigation.

    When at war? Give a pay raise to NASA employees

    You would think when our country is at war, our soldiers are dying, and we are spending billions of dollars that we do not have, the last thing our government would do is give Federal Employees a 3.5% pay raise. Go calculate.

    President Bush issued an executive order December 22, 2005, formally implementing a 3.1 percent average pay raise in 2006 for Federal employees covered by the General Schedule.

    The 2006 General Schedule pay changes will take effect on Sunday, January 8, 2006, and will appear in your January 27, 2006 paycheck. The pay increase includes a 2.1 percent base pay table increase for all General Schedule employees. Local Johnson Space Center employees will receive an additional 1.6 percent locality pay adjustment for a average pay increase of 3.41 percent. White Sands Test Facility and JSC employees duty stationed at KSC will receive a .8 percent locality pay adjustment for a average pay increase of 2.83 percent. These changes result in locality pay adjustments of 26.37 percent for the Houston area and 12.52 percent for the White Sands and KSC areas.

    Also, the maximum payable rate for the General Schedule's pay tables is increased from $140,300 to $143,000 for 2006. In Houston Grade GS-15 Steps 9 and 10 remain capped, but at the new ceiling of $143,000.

    Additionally, OPM has determined that employees on Special Salary rates will receive a 2.1 percent increase. At JSC these are predominantly entry level engineers in specific Information Technology occupations.

    Nick Lampson kicks off race for Congress in Clear Lake

    Former Congressman Nick Lampson officially announced his candidacy for Congress in District 22 at Tequila Willies in Clear Lake with over 150 of his supporters and a wide range of media.

    Lampson was introduced by Richard Morrison who ran for Congress in 2004. Richard was well received with long applause. Bob Gammage the last Democrat to hold the Congressional seat in District 22 was there to greet Lampson. Bob Gammage is running in the primary against Chris Bell for Governor. Sherrie Matula running for State Representative and Janette Sexton running against Robert Talton was also in attendance.
